Terms & Conditions

Last updated: May 2026. These terms govern participation in the Nakuru Business & Talent Awards 2026 ("NBTA"). By nominating, voting, sponsoring, or attending, you accept these terms in full.

1. Eligibility

Nominees must be individuals, businesses, or organizations operating within or with a clear connection to Nakuru County, Kenya.

Nominees must be at least 18 years of age, or, in the case of registered entities, legally constituted under Kenyan law.

NBTA organizers, jury members, and their immediate family are not eligible to be nominated in any category they directly evaluate.

2. Nominations

Nominations may be submitted by any member of the public through the official NBTA website, or added directly by the NBTA administration team.

Public nominations are subject to review and approval by NBTA administration before appearing on the public voting platform. Admin-added nominees are published immediately.

All nominees, regardless of how they enter the system, are treated equally and compete under the same rules within their respective categories.

NBTA reserves the right to reject, edit, recategorize, or remove any nomination that is incomplete, misleading, defamatory, fraudulent, or otherwise inconsistent with the spirit of the awards.

3. Voting

Voting is conducted exclusively through the official NBTA platform via M-Pesa payment. Each vote requires a valid M-Pesa transaction at the published rate per vote.

Votes are final once payment is confirmed. There are no refunds for completed M-Pesa transactions, except in the case of a verified system error.

Any attempt to manipulate the voting system — including bots, scripts, duplicate transactions in bad faith, or coordinated fraud — will result in disqualification of the affected nominee and forfeiture of votes, without refund.

NBTA reserves the right to audit all transactions and to invalidate votes that fail integrity checks.

4. Payments

All payments are processed through Safaricom M-Pesa. NBTA does not store M-Pesa PINs or full transaction credentials.

Contributions made via voting support the operational and production costs of the awards and are non-refundable.

Receipts are issued automatically via the M-Pesa confirmation message and reflected in the NBTA admin records.

5. Judging & Winners

Winners in public-vote categories are determined by the highest verified vote count at the close of voting.

Jury categories, where applicable, are decided by an independent panel whose decision is final.

NBTA reserves the right to combine, split, or withdraw any category if entries do not meet the minimum quality or quantity threshold.

Winners will be announced at the official NBTA 2026 gala and published on the NBTA website and social channels.

6. Use of Name, Likeness & Submissions

By submitting or accepting a nomination, nominees grant NBTA a non-exclusive, royalty-free license to use their name, likeness, logo, photography, and submitted materials for the promotion of the awards across all media.

Nominees confirm they own or have the right to use any materials they submit and that those materials do not infringe on third-party rights.

7. Code of Conduct

Nominees, voters, sponsors, and attendees agree to conduct themselves with respect, integrity, and professionalism.

Harassment, hate speech, discrimination, or unlawful behavior in connection with the awards will result in disqualification and may be reported to the relevant authorities.

8. Privacy

Personal data collected through nominations and voting is used solely for the administration of the awards and is handled in line with the Kenya Data Protection Act, 2019.

NBTA does not sell personal data to third parties.

9. Liability

NBTA, its partners, and sponsors are not liable for any indirect, incidental, or consequential loss arising from participation in the awards, technical issues, or third-party payment failures.

Participation in the awards is voluntary and at the participant's own discretion.

10. Changes to These Terms

NBTA may update these terms at any time. Material changes will be communicated via the official NBTA website. Continued participation after such changes constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of the Republic of Kenya. Any dispute arising from the awards shall be resolved in the courts of Nakuru, Kenya.
